Abstract:
The study titled: The Basics and Standards of the Company’s Nationality. The aims of this study are: to know the national or international legal firmware of the company’s nationality, the legal impact of the company nationality, the rules of law that controls the activities of the company and to convoying with economic developments, the global, and confirmation supremacy of national law especially in case of conflict about the nationality of company.
The study highlights the legal concept of the formalism and objectivity of the company’s nationality and through that faced several problems represented in standards, non-standardized and no power of the authentic.
A descriptive analytical approach has been used to conduct the study and the legal impacts produced by the company’s nationality. The study concluded with some results multiplicity of standard is considered one of the obstacles of principle of the rule of law.
Beside these results there are some proposals we think that they help to conclusiveness of the arguable in conflict of private law about the company’s nationality such as: the company’s nationality need more renewable studies and suitably rules to accommodative the economic development and the globalization.
Additionally the force of authentic of the basics and standards may arrange and must take the burliest in case of finding more standards. Key words: Basics and standards, Company’s Nationality, Activity center, Control, Legal status.
